Portuguese Government Declares Justice for All Avatars

The e-Justice Centre, sponsored by Portugal’s Ministry of Justice, now offers arbitration and mediation for all Second Life users (avatars). The government program, which kicked off on July 30th, offers arbitration and mediation rules that guide the resolution of business disputes conjured up in the 3-D virtual world called Second Life.

Second Life business disputes arise from the buying and selling of virtual real estate and merchandise. During the first half of 2007, Second Life users carried out $38.7 million worth of transactions.

The government of Portugal was motivated to create this Internet-based dispute resolution program so as to promote alternative means of resolving disputes. João Tiago Silveira, secretary of state for justice, notes in a Bloomberg.com article, that there are an excessive number of cases in the Portuguese courts. The country hopes that arbitrating and mediating Second Life disputes will raise awareness of its real-world ADR programs.

Settling disputes with ADR is advantageous because of the cost and time savings as compared to resolution through the courts. While there are many arbitration administrators that operate under various rules, procedures and policies, the National Arbitration Forum rules require that arbitrators follow the substantive law. This produces known standards and predictable awards.
